ERC Round 1 Citings: Seymour, Hines, Koyamaibole: Law 10.4 (b) (m) & (j): Referees Are Citing All Infringements No Matter Who The Player!

Please see below details of three citings arising from Round 1 of the Heineken Cup and Amlin Challenge Cup.
Note that under the new IRB Regulation 17, a cited player is not eligible to play until the disciplinary process is concluded.

TOMMY SEYMOUR – CITING
ERC has received a Citing Complaint against Glasgow Warriors wing, Tommy Seymour (No 14), following the Heineken Cup Pool 4, Round 1 match against Northampton Saints on Sunday, 14 October 2012.

Seymour is alleged to have carried out a dangerous tackle on the Northampton Saints wing, Vas Artemyev (No 11), during the second half of the match at Franklin’s Gardens.

The complaint was made by Citing Commissioner, Yves Thieffine (France).

The independent Judicial Officer appointed to hear the complaint is Simon Thomas (Wales), and the hearing will take place on Thursday, 18 October 2012.

Law 10.4 (j) – Lifting a player from the ground and either dropping or driving that player’s head and/or upper body into the ground whilst the player’s feet are off the ground.

Under the IRB Recommended Sanctions for Offences Committed within the Playing Enclosure, Law 10.4 (j) carries the following penalties: Low End: 4 weeks; Mid Range: 8 weeks; Top End: 12+ to 52 weeks. Note that under the new ‘IRB Sanctions for Foul Play’ table that was introduced this season, the entry point for sanctions for tip tackles was increased by 33 per cent.

NATHAN HINES – CITING
ERC has received a Citing Complaint against ASM Clermont Auvergne lock Nathan Hines (No.5), following the Heineken Cup Pool 5, Round 1 match against Scarlets at Stade Marcel Michelin on Saturday, 13 October 2012.

Hines is alleged to have stamped on Scarlets wing, Morgan Stoddart (No 11), during the first half of the match. The complaint was made by Citing Commissioner, John Cole (Ireland).

The independent Judicial Officer appointed to hear the complaint is Simon Thomas (Wales), and the hearing will take place on Thursday, 18 October 2012.

Law 10.4 (b) A player must not stamp or trample on an opponent.
Under the IRB Recommended Sanctions for Offences Committed within the Playing Enclosure, Law 10.4 (b) carries the following penalties: Low End: 2 weeks; Mid Range: 5 weeks; Top End: 9+ to 52 weeks.

SISA KOYAMAIBOLE – CITING
ERC has received a Citing Complaint against Bordeaux-Begles forward Sisa Koyamaibole (No 8), following the Amlin Challenge Cup Pool 1, Round 1 match against London Irish at Stade André Moga on Saturday, 13 October 2012.

Koyamaibole is alleged to have committed an act contrary to good sportsmanship in that he bit London Irish replacement Declan Danaher (No 20), during the second half of the match.

The complaint was made by Citing Commissioner, John West (Ireland).

The independent Judicial Officer appointed to hear the complaint is Antony Davies (England) and the hearing will take place on Wednesday, 17 October 2012.

Law 10.4 (m) Acts contrary to good sportsmanship – Biting
Under the IRB Recommended Sanctions for Offences Committed within the Playing Enclosure, Law 10.4 (m) carries the following penalties for Biting: Low End: 12 weeks; Mid Range: 18 weeks; Top End: 24+ to 208 weeks.

NOTES TO EDITORS

i) Citing Commissioner
a) Citing Commissioners are appointed by ERC for all Heineken Cup and all televised Amlin Challenge Cup matches and shall be entitled to cite a Player for any act or acts of Foul Play that in the Citing Commissioner’s opinion warranted a citing.
b) For such matches Clubs will not have the power to cite a player but may refer incidents to the Citing Commissioner within 24 hours of the conclusion of the match.
c) The Citing Commissioner will have 50 hours from the start of the game to make a citing. In exceptional circumstances this deadline can be extended.
d) The ERC Disciplinary Officer, Roger O’Connor may forward the submitted Citing to a Citing Officer to determine whether there are sufficient grounds for the citing to progress.
e) The Disciplinary Officer will then bring a charge against the cited player.

(ii) Disciplinary Hearing
a) The independent Judicial Officer is chosen by the Chairman of the independent Disciplinary Panel, Professor Lorne Crerar.
b) ERC’s Disciplinary Officer, Roger O’Connor, presents the case against the player.
c) Both parties to the hearing (ERC and the player) have the right to appeal decisions of the independent Disciplinary Hearing. Appeals must be lodged within 3 working days of receiving the full written decision of the independent Judicial Officer.
d) The full written decision of the independent Judicial Officer will be available on www.ercrugby.com/disciplinenews when the disciplinary process is complete
